Terms and Conditions

Article 1 – Definitions

In these Terms & Conditions:

  • Consumer means any natural person who is not acting for purposes relating to a trade, business or profession and who enters into a distance contract with the entrepreneur.

  • Entrepreneur means Avery Rowe / TW Ecom, offering products to consumers via an online store.

  • Distance contract means a contract concluded within the framework of an organised distance‑sales system, using one or more means of distance communication.

  • Right of withdrawal means the consumer’s right to cancel the distance contract within the cooling‑off period.

  • Cooling‑off period means the period within which the consumer may exercise the right of withdrawal.

Article 3 – Scope

  1. These Terms & Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between Avery Rowe and the consumer.

  2. Before the contract is concluded, the text of these Terms & Conditions is made available on the website in such a way that the consumer can store and reproduce it.

  3. By placing an order on the website, the consumer confirms that they have read, understood and agreed to these Terms & Conditions.


Article 4 – The Offer

  1. If an offer is subject to a limited validity period or to specific conditions, this will be clearly stated in the offer.

  2. The offer contains a clear description of the products and, where applicable, any limitations (such as size availability, materials or care instructions). Obvious errors or mistakes in the offer do not bind the entrepreneur.

  3. Product images are for illustrative purposes only. Minor deviations in colour, texture or details may occur between the images and the actual products.

  4. All prices shown on the website are exclusive of VAT, import duties, customs‑clearance fees and other local taxes. Any additional charges related to import outside the consumer’s country are for the account of the consumer.


Article 5 – The Contract

  1. The contract is concluded when the consumer completes the order process on the website and the payment is successfully authorised or received.

  2. After the consumer has placed an order, the entrepreneur will confirm receipt by email. As long as the order confirmation has not been sent, the consumer may cancel the order.

  3. The entrepreneur reserves the right to refuse an order (for example in case of suspected fraud, incorrect pricing or unavailability of the product). If an order is refused, any payment already made will be refunded.


Article 6 – Right of Withdrawal

  1. For product purchases, the consumer has the right to withdraw from the contract within 30 days from the day after the consumer, or a third party indicated by the consumer (other than the carrier), has received the product. No specific reason is required.

  2. During the cooling‑off period, the consumer shall handle the product and packaging with care. The consumer may only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product, as they would be allowed to do in a physical store.

  3. To exercise the right of withdrawal, the consumer must notify the entrepreneur within the 30‑day period, preferably by email, stating the order number and the products to be returned.

  4. After notifying the entrepreneur, the consumer must send the products back within 14 days. Returns are sent to warehouses located outside the European Union (Asia, including China) and are at the consumer’s own cost and risk.


Article 7 – Effects of Withdrawal & Costs

  1. If the consumer exercises the right of withdrawal, the entrepreneur will refund all payments received for the products (excluding any extra delivery costs for non‑standard or express shipping options) within 14 days after:

    • the returned goods have been received, or

    • the consumer has provided proof that the goods have been shipped back, whichever occurs earlier.

  2. The entrepreneur may withhold reimbursement until the goods have been received and inspected, or until the consumer has supplied evidence of having sent the goods back.

  3. The direct cost of returning the goods is borne by the consumer. These costs can be higher than domestic returns because parcels are returned to warehouses in Asia (China).

  4. The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. The entrepreneur may reduce the refund accordingly.


Article 8 – Exclusion of the Right of Withdrawal

  1. The entrepreneur may exclude the right of withdrawal in the following cases:

    • Products made to the consumer’s specifications or clearly personalised.

    • Sealed products which are not suitable for return for reasons of health protection or hygiene, if the seal has been broken after delivery (for example underwear, lingerie, swimwear or certain personal‑care items).

    • Products which, by their nature, are not suitable for return, or which may deteriorate or expire rapidly.

  2. Any exclusion of the right of withdrawal will be clearly stated in the product description and/or at the time of ordering.


Article 9 – Price & Taxes

  1. During the validity period stated in the offer, the prices of the products will not be increased, except in cases of obvious error or where required by law (for example changes in VAT rates).

  2. All prices on the website are displayed exclusive of VAT, import duties, customs charges and clearance fees.

  3. Fulfilment and shipping take place from warehouses located outside the European Union. This means that postal or courier services may collect VAT, import duties and/or clearance fees from the consumer upon delivery in the destination country.

  4. These additional costs are not charged by the entrepreneur and cannot be reclaimed from the entrepreneur. Any applicable shipping costs, where charged, are shown separately at checkout before the order is confirmed.


Article 10 – Conformity & Warranty

  1. The entrepreneur warrants that the products comply with the contract, the specifications stated in the offer and the reasonable expectations of the consumer.

  2. If a product is defective, damaged or not as described, the consumer must notify the entrepreneur within a reasonable period after discovering the defect, preferably by email, including the order number and clear photos of the product and packaging.

  3. In case of defective or incorrectly delivered goods, the entrepreneur will provide an appropriate solution, such as repair (where applicable), replacement or a (partial) refund.

  4. This warranty does not cover damage caused by improper use, lack of proper care, accidents or unauthorised modifications by the consumer.


Article 11 – Delivery & Performance

  1. The entrepreneur will exercise due care when receiving and fulfilling orders.

  2. Delivery takes place at the delivery address provided by the consumer during the checkout process. The consumer is responsible for ensuring that the address details are correct and complete.

  3. Products are often shipped directly from warehouses located outside the European Union (including China). Estimated delivery times are indicated on the website and during checkout and are indicative only.

  4. If an order cannot be delivered, or only partially, the entrepreneur will inform the consumer as soon as reasonably possible and, where applicable, refund the relevant payment.

  5. The risk of damage to and/or loss of products passes to the consumer at the moment of delivery, or at the moment the products are reasonably offered for delivery at the given address.


Article 12 – Payment

  1. Payment is made during the ordering process using the payment methods available on the website (for example credit card, PayPal, local payment methods).

  2. The consumer must ensure that payment and billing details are correct and must inform the entrepreneur immediately of any errors.

  3. If a payment is reversed, refused or charged back after delivery, the entrepreneur reserves the right to cancel the order, claim the outstanding amount and/or suspend further deliveries until payment is received.


Article 13 – Complaints

  1. Complaints about the performance of the contract must be submitted to the entrepreneur as soon as possible, but no later than 14 days after the consumer has discovered the defect. Complaints should be described clearly and completely and sent preferably by email.

  2. The entrepreneur will respond to complaints within 14 days from the date of receipt. If a complaint requires a longer processing time, the entrepreneur will send an acknowledgement of receipt within 14 days indicating when a more detailed response can be expected.

  3. The consumer must give the entrepreneur at least 4 weeks to resolve the complaint in mutual consultation. If the complaint cannot be resolved within this period, the consumer may consider further legal steps or contact the competent dispute‑resolution body (where applicable).


Article 14 – Returns, Refunds & Non‑Collected Parcels

  1. The conditions for returns and refunds are further detailed in the Refund & Return Policy, which forms part of these Terms & Conditions.

  2. If a parcel is not collected from a pick‑up point, refused at delivery, or returned to the entrepreneur without a formal return request, the entrepreneur may:

    • refund the product price minus any outbound shipping costs and return‑to‑sender fees charged by the carrier, and/or

    • deduct up to 15% of the original order value to cover handling, processing and logistics costs.

  3. Any remaining amount, where applicable, will be refunded to the original payment method once the returned parcel has been received and processed.


Article 15 – Privacy & Data Protection

  1. The entrepreneur processes personal data in accordance with applicable data‑protection laws and the Privacy Policy published on the website.

  2. The Privacy Policy explains which personal data is collected, for what purposes it is used, with whom it may be shared (such as payment providers, fulfilment partners and analytics/advertising partners) and which rights the consumer has in relation to their personal data.


Article 16 – Disputes & Applicable Law

  1. Contracts between Avery Rowe and the consumer are governed exclusively by Dutch law, even if the consumer resides outside the Netherlands.

  2. Any disputes arising from or related to these Terms & Conditions, the contract or the use of the website shall be submitted to the competent court in the Netherlands, without prejudice to mandatory consumer‑protection rules that may grant the consumer additional rights in their country of residence.
